Legislation Addressing the EU Pay Directive
Succinct summary of the legislation:
As of today, Spain has not yet transposed Directive (EU) 2023/970 into national law.
At this stage, we cannot confirm when the legislation transposing the Directive will be published or enter into force, as there are currently no official updates or concrete news in this regard.
In principle, the Spanish legislation is expected to cover the main obligations under the Directive, including pay transparency before employment, pay information rights, gender pay gap reporting, pay audits, joint pay assessments and enforcement mechanisms. However, the exact scope remains to be confirmed.
There is currently no official indication as to whether Spain will transpose the Directive exactly as written or whether it will introduce additional or stricter requirements.
